Provider Terms

1. Scope

These Provider Terms supplement the Terms of Use for providers who use Feierfunk commercially to present, quote or enable online booking of event services.

2. Identity and mandatory information

Providers must provide genuine and up-to-date company/personal information, a serviceable address, a business contact option and all mandatory information relevant to their activity. Register, tax, licence or supervisory information must be provided where legally required for the respective provider. Feierfunk may request evidence and disable online bookings until the information is complete.

3. Prices, offers and consumer information

Providers are responsible for the scope of services, total price, availability and all of their own pre-contractual consumer information. Before online booking is activated, providers must store their own booking/service terms, cancellation/refund rules and the withdrawal information applicable to the specific service. Feierfunk does not replace individual legal advice for the provider.

4. Success commission

Under the FREE plan, Feierfunk's success commission is 10% of the booking value paid through Feierfunk. Under PRO, it is 6%. The commission is technically accounted for in payment processing. In the event of a full refund, the platform commission is adjusted in accordance with the actual payment/refund process; for partial payments or cancellation charges, the commission may apply to the amount actually retained by or paid to the provider.

5. PRO annual membership

PRO is initially intended exclusively for providers acting commercially/as businesses and normally costs €199 per year. The launch offer costs €149 in the first contract year for eligible first-time subscriptions and then €199 per year. PRO membership renews for another year unless cancelled at the end of the current contract year. Cancellation can be scheduled at any time in the provider dashboard for the end of the term and withdrawn before then. The launch offer ends eight weeks after the official launch start triggered once in the admin area or after 100 PRO subscriptions, whichever occurs first. The first 50 eligible Launch PRO providers receive the permanent “Founding Provider” profile badge. PRO and Founding badges do not create a hidden ranking advantage.

6. Payment processing and Stripe Connect

Stripe Connect is not yet live. Once Feierfunk activates online payment processing, the provider must complete the required Stripe Connect setup for paid online bookings, including identity, business and payout requirements. Stripe then processes payments and payouts under its applicable agreements. Feierfunk is not intended to manually hold provider proceeds in its own intermediary account.

7. Platform contact and commission circumvention

If initial contact between customer and provider is made through Feierfunk and the specifically mediated service is subsequently booked as a result of that contact, the agreed Feierfunk success commission may not be circumvented merely by moving payment or booking outside the platform. Direct communication between customer and provider remains permitted. In the event of a specific suspicion of abuse, Feierfunk may request appropriate evidence to attribute a mediated booking.

8. Tax/platform reporting obligations

Providers must keep the master data required for statutory platform and tax-reporting obligations complete and up to date. Where Feierfunk is required to act as a reporting platform operator under the German Platform Tax Transparency Act, legally specified provider, remuneration and transaction data may be collected, verified and reported to the competent authorities. Affected providers are informed to the extent required by law. If legally required information is not provided despite repeated requests, Feierfunk may restrict functions, visibility or payouts until completion in accordance with applicable law.

9. Ranking and data access

The main ranking parameters are set out under Marketplace & Ranking. FREE, PRO and Founding status do not affect the normal default ranking. Paid highlights, if introduced later, will be shown separately and clearly marked as sponsored. Providers can access their own profile, offer, booking and billing data through their account, but not general data of other users.

10. Rights to content

Providers may use only content for which they hold the necessary rights. They grant Feierfunk the non-exclusive rights of use required for platform operation, display, technical adaptation and moderation.

11. Suspension and termination

Feierfunk may restrict functions, bookings or accounts in cases of illegal content, false identity/business information, fraud, commission circumvention, security abuse or repeated violations. Where legally required, reasons and appeal/contact options will be communicated.

12. Changes

Changes affecting commercial providers will be announced in accordance with the applicable legal requirements. Mandatory rights and statutory termination/information obligations remain unaffected.
